Equity is commonly alerted to overly onerous or restrictive clauses requiring artists not do anything to bring the producer, client, product, sponsor, and/or the artist’s character into disrepute, contempt, scandal or ridicule.

Equity recommends that that artists (and agents) do not agree to these clauses given they are broad, can compromise artist rights, and expose them to legal ramifications.

Agreement, disclosures and warranties must be specifically defined, reasonable in the circumstances, and relate to a legitimate commercial or employment purpose.
