Participants will be taught (and have the opportunity to ask questions) about the following: · How do you assess the risk involved when pursuing or defending a copyright claim? · What are some tips for drafting and responding to letters of complaint? · What court would you go to and what are the procedures involved? · What legal costs are involved in going to court, including those of your lawyer and the consequences for losing a trial? · If you win the trial, what kind of damages might you win? · If you go to Court and win, what damages can you expect to receive? And even if you win – is it worth it? · The cross-border problem: what do you do if the fight is with someone overseas? The Masterclass will end with a workshop where participants can consider a practical application to some potential scenarios. This session is pitched towards content makers and users – as well as in-house legal counsel (especially those fortunate enough to deal with copyright complaints too often) – but all are welcome. Questions and group participation will be encouraged. |
